JLG is in attendance for week 2 of the closing submissions of the Prohibited Defeat Device (PDD) trial, which will last for 3 weeks. This follows the Court hearing 10 weeks of evidence at the end of last year. These 3 weeks give the claimants and car manufacturers a final chance to put their case to the judge before the liability judgment is handed down, expected in the summer of 2026.
The PDD trial concerns 20 sample diesel vehicles manufactured between 2012 and 2017 by five major car makers: Mercedes, Ford, Peugeot/Citroën, Renault and Nissan. The Court is being asked to determine whether these vehicles were fitted with prohibited “defeat devices” designed to manipulate emissions testing processes.
The Pan-NOx litigation is one of the largest collective actions ever heard in the courts of England and Wales. During closing submissions, counsel for the claimants emphasised the substantial body of domestic and international case law addressing similar issues in other jurisdictions.
