The Pan-Nox PDD Trial has now been in the High Court for a month. Here’s an update on weeks 4 + 5 of one of the most significant emissions-related cases ever heard in the UK.

Week 4 (November 3 – 7)

The week resumed with the cross examination of the Claimant experts for Mercedes in their findings of levels of emissions in sample vehicles.

The experts focused on various technical points including efficiency of the Selective Catalytic Reduction (SCR) system, conversion rate, ammonia slip, and catalyst temperature etc.

Counsel of the Claimants cross examined the Defendants’ experts which led to helpful admissions such as active online dosing in emissions tests.

One of the Defendants’ experts claimed emissions concepts only applied to the new European Driving Cycle (NEDC) tests but eventually agreed that manufacturers must explain the exceeding conformity factors in test results.

Week4 concluded the Mercedes evidence with Counsel for the Claimants feeling that there was some strong performances from the Claimants’ experts as well as useful concessions made by the Defendants’ experts which will help the case going forward.

 

Week5 (November 10 – 15)

Week5 will resume with the Ford element of the trial, starting with cross examination by the Claimant team to the expert on behalf of Ford, and then expert evidence on behalf of the Claimants.
